Q: What does this tool do?
The Execution (Incarceration) Calculator is developed to calculate the actual time convicts will spend in prison. It automatically calculates the conditional release period, supervised release (probation) period, and the time to be spent in closed and open prisons within the scope of Law No. 7242 and the 11th Judicial Package.
Q: Who can use it?
The tool is primarily designed for the professional use of lawyers. It is for informational purposes only and absolutely does not constitute legal advice. A lawyer must be consulted for any legal decisions.
Q: Which legal regulations does it cover?
The tool is based on the Law No. 5275 on the Execution of Sentences and Security Measures, amendments to Law No. 7242, Law No. 7456 (11th Judicial Package — Provisional Article 10/6), and the Regulation on Transfer to Open Penal Execution Institutions (Art. 6).
Q: What should I select in the "Type of Convict" field?
There are two options: Adult and Child (Juvenile Dragged into Crime - SSÇ). Mark the appropriate option according to the convict's age on the date of the crime. This selection determines the different execution rates applied to children.
Q: Why should I enter the date of the crime?
The date of the crime is the basis of the calculation because:
Before/After 28/06/2014: Rates change for certain crimes such as sexual offenses and drugs.
11th Judicial Package: Only crimes committed on or before 31/07/2023 can benefit from this package.
01/07/2016 distinction: Affects supervised release periods for certain crimes.
Q: What does "Multiple Crimes (Joinder of Crimes)" mean in the "Number of Crimes" field?
This option is selected if the convict has finalized sentences for more than one crime and these are to be merged (joinder). In case of joinder, the date of the last committed crime must be entered in the "Date of Crime" field.
Q: What does "Recidivist (Mükerrir)" mean?
Recidivism is when a person who has a previously finalized sentence commits a crime again. In this case, the tool automatically compares and applies the method (2/3 execution or crime-specific execution + additional time) that is in favor of the convict.
Q: What does "Conditional Release Discount" mean?
It is the conditional release of the convict after a certain portion of the sentence (1/2, 2/3, 3/4, etc., depending on the type of crime) has been served in prison.
Q: What do the "With 11th Judicial Package" results mean?
If the date of the crime is eligible, the convict is granted the right to benefit from supervised release 3 years earlier and transfer to an open prison 3 years earlier. The condition of staying in an open prison for at least 3 months is required. Some serious crimes (terrorism, sexual assault, etc.) are excluded from this package.
Q: How are closed and open prison periods determined?
Calculations are made in accordance with Article 6 of the Regulation on Transfer to Open Penal Execution Institutions. The minimum duration in a closed prison is determined according to the total execution period and type of crime. When the remaining time for conditional release falls below the threshold, the transfer to an open prison is calculated.
Q: Does the tool work offline?
Yes. It is entirely HTML and JavaScript-based; it does not require a server connection. You can use it offline by opening the file in your browser.
Q: What should I do if the calculation gives an error?
Make sure all mandatory fields (date of crime, sentence duration, etc.) are filled. In case of missing or invalid data, the tool will display an automatic validation warning.
NOTICE: The results of this tool are not definitive. It is for informational purposes only and does not constitute legal advice. Every case may have its own specific conditions. A lawyer must be consulted for a definitive calculation. If you detect any errors, you can send an e-mail to info@sagalawfirm.com.
